ARTICLE 1 – SELLER IDENTIFICATION

The website www.musamia.com (hereinafter the “Site”) is operated by:

ARTICLE 2 – PURPOSE

These General Terms and Conditions of Sale (GTCS) govern sales made through the Site between MUSA MIA PRODUCTION SAS and any consumer making an online purchase.

Any order implies the Customer’s full and unconditional acceptance of these GTCS.

ARTICLE 3 – PRODUCTS

The products offered for sale are those presented on the Site on the date the order is placed.

Photographs and descriptions are provided for information purposes only. Minor variations may occur without affecting the essential characteristics of the products.

MUSA MIA PRODUCTION SAS reserves the right to modify or withdraw any product at any time.

ARTICLE 4 – PRICES

Prices are indicated in euros (€), including all applicable taxes (VAT included).

Any applicable delivery charges are indicated before the order is validated.

Products are invoiced based on the price in effect at the time the order is validated.

ARTICLE 5 – ORDERS

The Customer selects the products they wish to purchase and validates their order according to the process displayed on the Site.

The order becomes final once:

the shopping cart has been validated;
these GTCS have been accepted;
payment for the order has been successfully completed.

An order confirmation will be sent to the Customer by email.

MUSA MIA PRODUCTION SAS reserves the right to refuse or cancel any order in the event of fraud, non-payment or abusive use of the Site.

ARTICLE 6 – PAYMENT

Payment is due immediately when the order is placed.

The accepted payment methods are those offered on the Site.

Transactions are secured through the authorised payment service providers used by the Site.

ARTICLE 7 – DELIVERY

Products are delivered to the address provided by the Customer when placing the order.

Delivery times are provided for information purposes only.

MUSA MIA PRODUCTION SAS shall not be held liable for delays attributable to the carrier or resulting from force majeure.

Risk shall transfer to the Customer upon receipt of the parcel by the Customer.

ARTICLE 8 – RIGHT OF WITHDRAWAL

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal.

Any return or withdrawal request must be submitted through the official returns portal:

ARTICLE 9 – RETURN CONDITIONS

Returned items must be:

unworn;
unwashed;
undamaged;
in their original condition;
accompanied by their labels and any applicable accessories.

Any product returned incomplete, used or damaged may be refused.

Detailed return procedures are available on the Site’s returns portal.

ARTICLE 10 – REFUNDS

After receipt and inspection of the returned products, the refund will be made using the same payment method used for the original order.

The refund will be issued within a maximum period of fourteen (14) days, in accordance with applicable regulations.

ARTICLE 11 – EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to:

personalised products;
products made according to the Customer’s specifications;
unsealed products that cannot be returned for hygiene reasons;
digital content whose execution has begun immediately with the Customer’s prior consent.

ARTICLE 12 – LEGAL GUARANTEES

Products sold are covered by:

the statutory guarantee of conformity;
the statutory guarantee against hidden defects.

ARTICLE 13 – LIABILITY

MUSA MIA PRODUCTION SAS shall not be held liable for:

improper use of the products;
an error made by the Customer when entering their information;
an event of force majeure;
a temporary interruption of the Site.

The seller’s liability is limited to the amount of the relevant order.

ARTICLE 14 – PERSONAL DATA

Personal data collected is used exclusively for:

processing orders;
customer service;
legal and accounting obligations;
improving the services provided.

Data processing is carried out in accordance with the GDPR.

ARTICLE 15 – COOKIES

The Site uses cookies necessary for its operation and, where applicable, audience measurement or advertising cookies.

The Customer may manage their preferences through the cookie banner displayed while browsing the Site.

ARTICLE 16 – INTELLECTUAL PROPERTY

All content on the Site (texts, photographs, videos, logos, trademarks, graphics and visual elements) remains the exclusive property of MUSA MIA PRODUCTION SAS or its partners.

Any reproduction or use without prior written authorisation is prohibited.

ARTICLE 18 – MEDIATION

In accordance with the French Consumer Code, the Customer may refer the matter free of charge to a consumer mediator after submitting a written complaint that has not been resolved satisfactorily.

ARTICLE 19 – GOVERNING LAW

These GTCS are governed by French law.

In the event of a dispute, the parties shall first seek to reach an amicable resolution.

Failing this, the French courts shall have jurisdiction in accordance with the applicable legal provisions.
